The owner of a small Chicago mortgage company accused of violating the Equal Credit Opportunity Act and redlining has asked a federal judge to dismiss the
Consumer Financial Protection Bureau’s enforcement action on the grounds it violates his First Amendment rights.
Attorneys for the mortgage company’s owner contend the bureau’s action violates the First Amendment because it seeks to regulate the content and viewpoint of protected speech in a way that is unconstitutionally overbroad and vague.
